The agreement

Terms & Conditions

How quotes, access, payment and cancellation work — plus the things we can and cannot guarantee once a plant, a hedge or a lawn is involved.

These are the terms on which we carry out garden work. They are written to be readable, and most of them are simply the things we would tell you on the phone anyway: the quote is fixed, the waste is included, we will not cut a protected tree without consent, and if something is wrong we come back and fix it.

Nothing here affects your statutory rights as a consumer. Our privacy policy covers what happens to your personal information.

These terms

These terms apply to garden and landscaping work carried out by West London Garden Rescue of Uxbridge, West London(“we”, “us”). They apply when you accept a quote from us, whether that acceptance is given by phone, text, WhatsApp, email or in person.

Nothing in these terms removes or reduces your legal rights as a consumer. If any part of these terms conflicts with those rights, your legal rights take precedence.

Quotes and prices

Quotes are free and carry no obligation. Every quote we give is a fixed price for the scope of work described in it, not an hourly or day rate. The price we quote is the price you pay for that scope.

Quotes are valid for 30 days unless we state otherwise, and include removal and licensed disposal of waste arising from the work unless expressly excluded.

A quote can only reflect what we were able to see or were told about. If something materially different is discovered once work begins — for example a substantially larger volume of waste than the photographs showed, buried concrete or hardcore, asbestos or other hazardous material, or a boundary dispute — we will stop, explain the position, and agree any change in price with you before continuing. We will never carry out additional chargeable work without your agreement first.

Where you ask for additional work while we are on site, we will agree the extra cost with you at the time.

Booking and scheduling

A booking is confirmed once we have agreed a date with you. We do not take a deposit on standard clearance, maintenance or tidy-up work. On larger landscaping and paving projects where we purchase significant materials in advance, we may ask for a materials payment, and we will tell you this at quote stage rather than after you have booked.

We will confirm an arrival window ahead of the visit. Garden work is weather-dependent: most clearance, hedge and tree work continues in ordinary British conditions, but turfing, paving, jointing and pressure washing may need to be rescheduled. If we have to move a date we will tell you as early as we can and offer the earliest practical alternative.

Access and your responsibilities

So that we can carry out the work, you agree to:

  • Provide access to the garden on the agreed date, and to water or electricity where the job requires it (pressure washing and turfing do).
  • Tell us about anything relevant that is not visible — buried services, cables, irrigation, septic tanks, soakaways or pet graves.
  • Point out anything fragile, valuable or sentimental that needs protecting or avoiding.
  • Confirm that you own the property, or have the owner's permission for the work, including for any tree or boundary work.
  • Keep children and pets clear of working areas while equipment is in use.

If we arrive on the agreed date and cannot gain access, we may charge a reasonable contribution toward the wasted visit. We will always try to contact you before treating a visit as wasted.

Trees, hedges and boundaries

We check for Tree Preservation Orders and conservation area status with the local authority before quoting tree work. Where consent or notice is required, work cannot begin until that process is complete — in a conservation area this normally means a six-week notice period. We will explain what applies to your property, but the final decision to proceed is yours.

We will not carry out work on a protected tree without the necessary consent, and we will not cut a tree or hedge that is not yours or that you do not have permission to have cut.

Between March and August we check hedges for active birds’ nests before cutting. Where an active nest is found we will leave that section of hedge and return once nesting has finished. This is a legal requirement under the Wildlife and Countryside Act 1981 and is not something we can work around at a customer’s request.

Where a fence or hedge sits on a shared boundary, you are responsible for establishing that you have the right to have the work done. We are happy to wait while you agree matters with a neighbour.

Carrying out the work

We will carry out the work with reasonable care and skill, and to the standard described in the quote. We will protect surrounding areas while working and leave the site swept and cleared.

Some outcomes depend on biology rather than workmanship, and we cannot guarantee them. In particular: conifers and other coniferous hedging will not regrow from old brown wood once cut back past the green; new turf will only establish if it is watered as instructed during the first weeks; regrowth from deep bramble, bindweed or Japanese knotweed root fragments can occur after clearance; and existing paving or fencing may reveal defects once cleaned or partially replaced.

Where we advise against a course of action and you ask us to proceed anyway, we will do so where it is safe and lawful, but we cannot accept responsibility for the outcome.

Waste removal

We remove waste arising from the work under our waste carrier licence and deliver it to a licensed transfer station. A waste transfer note is available on request, and we recommend landlords, letting agents and commercial customers keep one on file.

There are materials we are not permitted to remove: asbestos, paint and chemicals, tyres, fridges and freezers, gas bottles, and clinical waste. If any of these are present, we will point you to the correct disposal route.

Payment

Payment is due on completion of the work, once you have had the opportunity to see it. We accept bank transfer and cash. Landlords, letting agents and commercial customers may be invoiced on agreed terms, with payment due within 14 days of invoice unless otherwise agreed.

On multi-stage landscaping projects we may agree a staged payment schedule at the outset, tied to completion of defined phases.

We may charge statutory interest on genuinely overdue commercial invoices. We would always rather talk to you about a payment problem than pursue one.

Cancellation and your right to cancel

Because we agree contracts with consumers away from our business premises, you have a statutory right to cancel within 14 days of agreeing the work, without giving a reason and at no cost.

If you would like the work to start inside that 14-day period, we will ask you to confirm that expressly. Where you do, and you then cancel during the period, you may be asked to pay for work already carried out and materials already supplied up to that point. If the work has been fully completed at your express request within the period, the right to cancel is lost.

Outside the statutory period, please give us as much notice as you can so the slot can be offered to someone else. We do not charge a cancellation fee on standard domestic work. Where non-returnable materials have already been purchased specifically for your job, we may ask you to cover their cost.

To cancel, simply tell us — a phone call, text, WhatsApp message or email is sufficient.

If something is not right

Tell us. Contact us on 07386 556242 or at quote@westlondongardenrescue.co.uk and we will come back and put right anything that falls short of what was quoted. We would far rather fix a job than leave a customer unhappy.

Under the Consumer Rights Act 2015 our work must be carried out with reasonable care and skill. Where it has not been, you are entitled to have it put right, or to a price reduction if that is not possible within a reasonable time.

Damage is rare but garden work involves heavy material in confined spaces. We hold public liability insurance covering the work we carry out, so if we damage something, tell us and we will resolve it. Our certificate of insurance is available on request.

Liability

We are responsible for loss or damage you suffer that is a foreseeable result of our breaking this contract or failing to use reasonable care and skill.

We do not exclude or limit our liability in any way where it would be unlawful to do so — including for death or personal injury caused by negligence, for fraud, or for any breach of your statutory rights as a consumer.

We are not liable for pre-existing defects revealed by our work, for subsequent plant failure caused by drought, frost, pests or a lack of aftercare where instructions were given, or for the consequences of inaccurate information provided to us about the property or its boundaries.

Photographs of completed work

We usually photograph work before and after as a record of the job. We will not publish any photograph of your garden on this website, on social media or in advertising without asking you first, and you can withdraw that permission at any time. See our privacy policy for detail.

General

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction over any dispute.

If any provision of these terms is found to be unenforceable, the remaining provisions continue to apply. We may update these terms from time to time; the version that applies to your job is the one published when you accepted the quote.
